According to the Palestinian news agency WAFA, Palestine has presented its statement to the relevant preliminary examination division of the ICC, evaluating the request for an 'arrest warrant' for Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant. In the statement presented by Palestine, it was emphasized that the ICC has the jurisdiction to prosecute Israeli officials who have committed crimes in Palestinian territories. It was pointed out in the statement that any attempts to politicize or undermine the legal jurisdiction of the ICC would deprive the Palestinian people of justice, and the ICC was requested to firmly reject such attempts. The statement emphasized that the ICC wanted to highlight its jurisdiction over Israelis in the shadow of the blackmail campaigns it was exposed to. Omar Abdullah, Director of International Organizations Affairs at the Palestinian Ministry of Foreign Affairs, expressed hope that the ICC would issue an international arrest warrant for Netanyahu and Gallant, albeit late, due to obstruction by some countries. The United Kingdom had initially raised objections to the issuance of arrest warrants for Netanyahu and Gallant by the ICC but later withdrew its objection. Abdullah also mentioned that due to an incident where the United Kingdom objected to the arrest warrants, the ICC had requested statements from many states and international organizations to determine whether it could exercise jurisdiction over Israeli citizens. The ICC Pre-Trial Chamber had instructed the United Kingdom to submit their written observations by July 12, 2024. The ICC, under Rule 103 of the Rules of Procedure and Evidence, may allow a state, organization, or person to submit views, whether written or oral, in order to ensure that the trial is properly concluded. This procedure, known as Amicus Curiae (Friend of the Court), is used by many countries and organizations to influence the Court's decision. The non-binding nature of these statements allows for various opinions to be considered before a decision is made. The Prosecutor has the right to respond to Amicus Curiae statements submitted to the ICC. The ICC had previously allowed Amicus Curiae statements in the case of former Sudanese President Omar al-Bashir and regarding jurisdiction in Palestinian territories. Chief Prosecutor Karim Khan had applied for an 'arrest warrant' for Netanyahu and Defense Minister Yoav Gallant on May 20. Khan believed that there were reasonable grounds to believe that Netanyahu and Gallant bore criminal responsibility for 'war crimes and crimes against humanity' in the Gaza Strip since October 8, 2023. The crimes against Netanyahu and Gallant included 'starvation of civilians as a war crime,' 'infliction of great suffering or serious injury to body or health intentionally,' and 'inhumane treatment as a war crime.' Other charges against Netanyahu and Gallant included 'intentional killing,' 'murder as a war crime,' 'intentional attacks against the civilian population as a war crime,' 'destruction and/or murder as a crime against humanity, including deaths from starvation,' 'persecution as a crime against humanity,' and 'other inhumane acts as a crime against humanity.' The Chief Prosecutor emphasized that the indicated crimes against humanity were committed 'as part of a widespread and systematic attack on the Palestinian civilian population in accordance with state policy' and that these crimes were ongoing.
